NEW LONDON, Conn. — Rear Adm. Sandra Stosz, Superintendent, U.S. Coast Guard Academy, directed an Article 32 Investigation to determine the disposition of charges against a cadet who is accused of abusive sexual contact against another cadet at the Academy.
As a part of this investigation, a hearing will take place on Wednesday, April 2 in Hamilton Hall at the Academy. The hearing is open to the public and the media on a space available basis. The purpose of Article 32, UCMJ proceedings – also known as a pretrial investigation – is to inquire into the truth of the matters set forth in the charges, to consider the form of the charges, and to secure information to determine what disposition should be made of the case in the interest of justice and discipline. The Article 32 is functionally similar to that of a civilian grand jury. No verdict or sentencing is handed down, just a recommendation for case disposition to the Convening Authority, Rear Adm. Stosz.
The charges, which involve allegations of abusive sexual contact, housebreaking and unlawful entry, fall under Articles 120, 130 and 134 of the Uniformed Code of Military Justice.
“These charges are accusations against the cadet, who is presumed innocent unless and until found guilty by a court martial. The Coast Guard is committed to providing all needed support to the victim, and to ensuring a full and fair proceeding in compliance with the Uniform Code of Military Justice,” said Academy Assistant Superintendent, Capt. Eric C. Jones.
